Expungement Eligibility in Virginia
Our extensive knowledge of Virginia expungement laws allows us to zealously advocate for an expungement of criminal charges on your record.
It may be possible to expunge a criminal charge if you were found not-guilty. You are eligible if a judge or jury found you to be not-guilty of the original charge, the prosecutor moved for dismissal without prejudice or the charges were simply dismissed for lack of evidence or another reason.
If you were convicted and found guilty, your record cannot be expunged. Only the governor can grant an absolute pardon of your conviction to you. It is extremely rare for this to happen.
The Expungement Process in Virginia
TWe will prepare a petition and file it with the court. The petition explains the facts of your case, why you are eligible for an expungement and what you are asking the court to do. Included in the summary of the facts of your case are the following:
- The date of your arrest
- The department or agency making the arrest
- Possession of narcotics
- The exact charges to be expunged
- A certified copy of your arrest warrant
We will then follow the process through, meeting the strict statutory timelines along the way. Assuming the process goes smoothly from here, the court will then set a date to hear your case. We will stand with you at that hearing and advocate strongly on your behalf for expungement.
If the judge agrees that your arrest and charges should be expunged, the court will send the decision to the Virginia State Police. The State Police will remove the charges from their records and inform us that they have done so.
